1. General

These terms apply to all auctions and purchases via CCAuktioner — a registered secondary business name of Skånerot AB (org. no. 5566255849, VAT no. SE556625584901), Länsmansgatan 17, 282 72 Sösdala, Sweden. Skånerot AB is your contracting party. By placing a bid you accept these terms in full.

2. Registration and Account

Participation in auctions requires a registered account with accurate contact details (name, email, and phone; postal address is provided no later than at your first bid). You must be at least 18 years old to register and bid — a bid is a binding offer and an account may only be held by an adult. Inaccurate details may result in account suspension.

3. Bidding

• Bids are binding and cannot be withdrawn.
• The minimum bid is the starting price. Minimum bid increments are calculated automatically.
• Automatic maximum bid (proxy bidding) means the system bids on your behalf up to your stated maximum amount.
• If a bid is placed within the last 3 minutes, the auction is automatically extended by 3 minutes.
• CCAuktioner reserves the right, before bidding has closed, to cancel, withdraw, or void an auction in the event of technical errors, suspected bid manipulation, incorrect publication or mispricing, legal impediment, or other objective and material circumstances. Once bidding has closed and a contract of sale has been concluded, CCAuktioner may rescind the purchase only if the item may not lawfully be sold, or if the conditions in Section 32 of the Swedish Contracts Act (1915:218) concerning a manifestly incorrect statement of price are met; any amount paid is then refunded in full.
• Reserve price and counter-offers. If the final bid is below any reserve price, the seller may accept the bid, submit a counter-offer to the highest bidder, or decline. A contract is formed only when the seller (or the highest bidder accepting the counter-offer) agrees on the final price. The 14-day right of withdrawal nevertheless runs from the day after you receive the item.
• Right of withdrawal. When you place a bid on ccauktioner.se, a distance contract is formed between you and CCAuktioner. Under the Swedish Distance and Off-Premises Contracts Act (2005:59) you have, as a consumer, a 14-day right of withdrawal, counted from the day after you receive the item — for collection, the day after pickup; for shipping, the day after delivery. This right applies regardless of whether the underlying item was previously owned by a private seller: CCAuktioner sells as a commission agent in its own name and is therefore the seller in relation to you. Exercise the right using the withdrawal function in your account (available throughout the withdrawal period) or via the standardized withdrawal form at ccauktioner.se/angerratt.php. The buyer pays return shipping; collected items are returned to Länsmansgatan 17, 282 72 Sösdala, Sweden. Bulky items that cannot be returned by post can always be brought back to our premises free of charge; if you choose to arrange transport instead, you bear that cost yourself (typically SEK 500–2,500 for a courier or removal service within Sweden). The item must be returned or sent back without undue delay and no later than 14 days from the day you notified us of the withdrawal (Chapter 2, Section 13 of the Distance Contracts Act). Refund is issued within 14 days of notification, though payment may be withheld until the goods are received back or you have demonstrated return shipment. You may handle the item to establish its characteristics and functioning to the same extent as you would in a shop; if you handle it more than that, we may deduct for any diminished value of the item from the refund (Chapter 2, Section 15 of the Distance Contracts Act). This right is independent of, and applies in addition to, the 48-hour review window and statutory complaint rights described in §6.

4. Payment and Invoice

• Total price. You pay the final bid (hammer price). CCAuktioner does not charge a buyer's premium. CCAuktioner sells the items as a commission agent in its own name on behalf of the seller and does not add any separate VAT on the hammer price for you as the buyer. The applicable VAT treatment for the sale is shown on the invoice and does not affect the price you pay.
• Artist resale right on original art. For original works of art, statutory artist resale right (följerätt) may be added on top of the hammer price. So that you can calculate your total cost before bidding: no resale right is charged if the hammer price is below one twentieth of the price base amount (currently 2 960 SEK). Above that threshold the fee is calculated on the hammer price on a sliding scale — 5% on amounts up to EUR 50,000, then 3% (EUR 50,001–200,000), 1% (EUR 200,001–350,000), 0.5% (EUR 350,001–500,000) and 0.25% on amounts above EUR 500,000 — capped at EUR 12,500 per item (Swedish Copyright Act (1960:729), Chapter 2a, Sections 26n–26q). The fee is shown as a separate line on the invoice. The full scale is set out in the Seller Agreement § 10.
• After the auction closes, a combined PDF invoice is emailed to your registered address, covering the items you won in the same invoicing run.
• Payment must be made within 3 days of the invoice date.
• Payment is made via Swish (123-556677) or bank giro (5620-1460). Quote the invoice number as the payment reference.
• If payment is late, a reminder is sent by email. CCAuktioner is entitled to late-payment interest under Section 6 of the Swedish Interest Act (1975:635) from the due date, plus the statutory reminder fee and compensation for collection costs under the Act (1981:739) on compensation for debt collection costs.
• If payment is not received by the due date, CCAuktioner may rescind the purchase and resell the item. You may then be held liable for the difference between your bid and the resale price, as well as for the statutory reminder and collection costs. This never affects your right to instead withdraw from the purchase under §3.

5. Collection and Delivery

• Purchased items are collected at Länsmansgatan 17, 282 72 Sösdala, Sweden.
• Items must be collected within 7 days of the invoice being paid. Book a time at info@ccauktioner.se.
• Shipping: Buyers may choose shipping for an additional fee at the time of payment. Shipping cost, lead time, and conditions are stated on the invoice. As a consumer, risk of loss of or damage to the item passes to you only once you have taken possession of it (Chapter 2, Sections 3 and 6 of the Consumer Sales Act); if the item is damaged or lost in transit, CCAuktioner bears the risk. For buyers who are businesses, risk passes when the item is handed to the carrier.
• Delivery time when shipping. Where shipping is offered and chosen, CCAuktioner hands the item to the carrier without undue delay, normally within 5 working days and at the latest within 30 days of the purchase.
• If a paid item is not collected within the collection period, CCAuktioner may charge a storage fee of SEK 25 per item per commenced week from the day after the period expires. The fee corresponds to CCAuktioner's actual cost of continued storage and is invoiced to the buyer upon collection or, if the item is instead sold under the next clause, deducted from any sale surplus.
• If a paid item is not collected within the stated time, CCAuktioner may, after a written reminder and observance of the time limits in the Act (1985:982), sell the item for the buyer's account. Any surplus, after deduction of reasonable storage and sale costs, is paid out to the buyer. Stricter terms may apply to buyers who are businesses.

6. Condition and Complaints

• Each item must conform to the description, photos and information provided about it (Chapter 4, Sections 2–3 of the Consumer Sales Act). Items are second-hand and are sold with the condition and characteristics stated in the item's description. Any known deviations are stated specifically in the item's description. Stated deviations, together with the item's age and starting price, form part of the assessment of what you can reasonably expect as to the item's characteristics (Chapter 4, Sections 2–3 of the Consumer Sales Act).
• Colour rendering and sense of scale may vary between screens; photos do not replace the written description of condition and deviations. We encourage buyers to visit us in person to inspect items before bidding.
• Complaints about defects are handled under the Swedish Consumer Sales Act (2022:260). CCAuktioner's auctions are online timed distance contracts and do not constitute a public auction within the meaning of the Act (see e.g. ARN 2014-02631); the defect assessment therefore follows the general rule in Chapter 4, Sections 2–3 of the Consumer Sales Act. The assessment takes into account the item's age, the condition stated in the description, and the starting price — normal age-related wear and minor imperfections consistent with the item's age and starting price do not generally amount to a defect.
• Complaints must be raised within a reasonable time after the defect is discovered or ought to have been discovered (Chapter 5, Section 2 of the Consumer Sales Act). Buyers can file a complaint directly from their account at ccauktioner.se/konto/reklamation.php or contact us at info@ccauktioner.se.
• 48-hour review window after pickup. Once an item has been registered as collected by CCAuktioner, the buyer has 48 hours to report that the item does not match its description (e.g. hidden defect, damage or incorrect dating). CCAuktioner will review the case and hold the seller payout until a decision is made. This routine does not affect the statutory complaint rights set out in the Swedish Consumer Sales Act, and it applies in addition to — not instead of — the 14-day right of withdrawal described in §3.
• CCAuktioner is the seller in relation to you and is responsible for your rights under the Consumer Sales Act regardless of our internal relationship with the original seller.
• Complaints and right of withdrawal. What is described above are your statutory complaint rights under the Consumer Sales Act — not a voluntary guarantee from CCAuktioner. The right of withdrawal under §3 may in certain cases be excluded by law (Chapter 2, Section 11 of the Distance Contracts Act (2005:59)), e.g. for custom-made items or sealed goods that for health or hygiene reasons cannot be returned once the seal has been broken.
• Business buyers. For buyers who are not consumers, the following applies instead: items are sold as-is and Section 19 of the Sale of Goods Act (1990:931) does not apply; the buyer must inspect the item before collection or without delay after receipt; complaints must be made in writing no later than 7 days after collection or delivery, failing which the right to invoke the defect is lost. This clause never limits CCAuktioner's liability in cases of intent or gross negligence. The references to the Consumer Sales Act in this §6 do not apply to business buyers.

7. Limitation of Liability

Nothing in these terms limits the rights you have as a consumer under mandatory law, including the right to damages under the Consumer Sales Act (2022:260) and the rights under the Distance Contracts Act (2005:59). To the extent mandatory consumer law affords you wider rights, that legislation prevails over this section.

In relation to buyers who are not consumers (businesses), and otherwise to the extent permitted by mandatory law: CCAuktioner is not liable for indirect loss within the meaning of Section 67, second paragraph of the Swedish Sale of Goods Act (1990:931) arising from auction results, technical outages, or force majeure events, and CCAuktioner's liability is limited to the amount paid for the item. This limitation never applies in cases of intent or gross negligence.

8. Personal Data

Your personal data is processed in accordance with our Privacy Policy.

9. Disputes and Dispute Resolution

Disputes are resolved first through dialogue. Alternatively, a consumer may have the dispute reviewed by the Swedish National Board for Consumer Disputes (ARN), which handles disputes above ARN's applicable value threshold for the relevant case type (see arn.se). Submit a complaint at arn.se or by post to ARN, Box 174, SE-101 23 Stockholm.

A dispute may also be submitted to a Swedish general court under Swedish law.

10. Sellers

These terms apply to buyers on CCAuktioner. If you are a seller selling items on commission, your relationship with CCAuktioner is governed by the Seller Agreement, which covers commission, payouts, title, artist resale rights (följerätt), and DAC7 reporting to the Swedish Tax Agency.
